extensively damaged and I am informed that they will require to be rebuilt at an estimated cost of $18,000; furthermore, the

loss sustained by the British Section of the Railway through loss of user of these coaches may fairly be estimated at $1500.

3. I am further advised that under the Working

Agreement between the two Sections of the Kowloon-Canton

Railway no claim for damages can be sustained against the

Chinese Section in this instance and that the British Section

is required to provide rolling stock for through traffic

unless it finds itself unable to do so owing to "force

majeure", in which event through traffic is suspended.

I am unaware whether the British Government would

be disposed to prefer a claim against the Japanese Government

for any or all expenses incurred by the British Section of

the Kowloon-Canton Railway as a result of this incident, and

am content to leave the question in your hands.

5. A copy of this despatch has been sent to His

Britannic Majesty's Ambassador at Tokyo.
